A. Cancellation Policy

Introduction

Consumers have a right of cancellation in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity:

Right of Cancellation

You have the right to cancel this contract within fifteen days without giving any reason.

The cancellation period is fifteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the last goods.

To exercise your right of cancellation, you must inform us (AAVI GmbH, Frankfurter Str. 92, 65760 Eschborn, Germany, Tel.: +49 61 96 / 921 77-72, Email: team@ninety-9.de) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by mail or an email). You may use the attached model cancellation form for this purpose, although its use is not mandatory.

You may also exercise your right of cancellation online on the website at the following address: Cancellation of contract. If you use this online option, we will send you a confirmation of receipt on a durable medium (e.g. by email) without undue delay, including information about the content of the cancellation declaration as well as the date and time of its receipt.

To meet the cancellation deadline, it is sufficient for you to send the notification exercising your right of cancellation before the cancellation period has expired.

Consequences of Cancellation

If you cancel this contract, we will reimburse all payments we have received from you, including delivery costs (with the exception of additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fifteen days from the day on which we received notification of your cancellation of this contract. We will use the same means of payment that you used for the original transaction for this refund, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fifteen days from the day on which you notify us of the cancellation of this contract.

The deadline is met if you send the goods before the fifteen-day period has expired.

You will bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this diminished value is attributable to handling of the goods that was not necessary to establish their nature, characteristics and functioning.

Exclusion or Early Expiry of the Right of Cancellation

Partial Cancellation for Set or Bundle Orders at Discounted Prices:

If you have the right to cancel your order and exercise this right after submitting your contractual declaration to purchase a product set—but only with respect to one component of the set—we reserve the right, when calculating the pro-rata purchase price refund for the set component not affected by the cancellation, the price that would be due if purchased individually (i.e., without the discount available through the set purchase). In the case of the partial cancellation described above, the pro-rata purchase price to be refunded is therefore calculated as the difference between the purchase price paid and the individual purchase price for the set component not affected by the cancellation. However, this applies only if you were informed of the individual purchase price of the set components before submitting your declaration of contract, or if you could reasonably have determined the corresponding individual purchase prices based on available information before submitting your declaration of contract. The refund of shipping costs in the event of a cancellation (see above) remains unaffected by this.

The right of cancellation does not apply to contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

The right of cancellation does not apply to consumers who, at the time the contract is concluded, are not nationals of a member state of the European Union and whose sole place of residence and delivery address at the time the contract is concluded are outside the European Union.
